The City of D’Iberville, Mississippi, will receive bids for the Popp’s Ferry Road Relocation Phase IV Improvements project no later than 10:00 a.m., September 22, 2021 at City Hall, located at 10383 Automall Parkway, D’Iberville, Mississippi 39540. All bids so received will be publicly opened and read aloud.

The work shall consist essentially of the following items:

New asphalt roadway from Galleria Parkway to West of Nance Street with curb and gutter, sidewalks, sub-surface drainage and utilities, roadway lighting and installation of traffic signals. The project is located in the CITY OF D’IBERVILLE, HARRISON COUNTY, MISSISSIPPI.

The above general outline of features of the work does not in any way limit the responsibility of the contractor to perform all work and furnish all plant, labor, equipment and materials required by the specifications and the drawings referred to therein.

Bid documents are available via paper or digital copy. Interested bidders are required to log-in or register for an account at www.neel-schafferplans.com to view and order bid documents. Bidders who submit a Bid must be a Plan Holder of record at the issuing office. Bids from Bidders who are not on the Plan Holders List may be returned as not being responsive.

A certified check or bank draft payable to the order of City of D’Iberville, D’Iberville, Mississippi, negotiable U.S. Government bonds (at par value), or a satisfactory Bid bond executed by the Bidder and an acceptable surety, in an amount equal to five percent (5%) of the total bid and in compliance with Mississippi Code 83-17-21. If a bid bond is used, it must be signed or countersigned by a Mississippi Resident Agent of a surety company qualified and authorized to do business in the State of Mississippi in accordance with the laws of the State of Mississippi. In addition, said bond must be signed by the bidder. Any bid bond which does not contain these requirements shall be considered non-conforming and shall be rejected.

All bids submitted in excess of $50,000.00 by a prime or subcontractor to do any erection, building, construction, repair, maintenance or related work, must comply with Section 31-3-21, Mississippi Code of 1972. Bidder must be qualified under Mississippi Law and have a current Certificate of Responsibility from the State of Mississippi Board of Contractors establishing his Classification as to the value and type of construction on which he is authorized to bid. The scope of work for this project shall require a Contractor to be classified in the following category: Highway Street and Bridge Construction. Bidder shall write his Certificate of Responsibility Number on the exterior of the sealed bid envelope before it can be opened. The outside of the envelope should also bear the Bidder’s name, address, and name of the project for which the Bid is submitted.

Section 3: The Contracted Party will comply with Section 3 of the Housing and Urban Development Act of 1968, as amended (42 U.S.C. 1701u) and with the requirements of 24 C.F. R. Part 135 requiring that to the greatest extent feasible, opportunities for training and employment be given to lower income residents of the project area and contracts for work in connection with the project area be awarded to eligible business concerns which are located in, or owned in substantial part by persons residing in the area of the project.

This project is covered by the requirements of Section 3 of the Housing and Urban Development Act of 1968 (12 U.S.C. § 1701u) (“Section 3”). Section 3 requires that when employment or contracting opportunities are generated by HUD-funded projects, preference is given to low to moderate income persons and businesses residing in the community where the project is located. Any responsive, responsible bidder that qualifies as a Section 3 Business Concern will be given a preference during evaluation as set forth below. A bidder selected for this Project will be responsible for ensuring compliance with all Section 3 requirements including, but not limited to, the hiring and contracting decisions made on the Project.

All bidders are required to demonstrate commitment to the achievement of the KCDBG Section 3 goals in one of the following two ways:

(1) A bidder must certify as a Section 3 business concern; or
(2) A bidder must provide a Section 3 plan detailing how the bidder will meet the required Section 3 subcontracting goal of providing subcontracting opportunities to Section 3 business concerns in an amount not less than 10% of the total contract amount. In its subcontracting plan, the bidder should include the necessary number of Section 3 business subcontractors to meet or exceed the goal for this contract. The plan should also clearly state the total dollar value that will be self-performed and the total dollar value which will be subcontracted to Section 3 Business Concerns; providing for each listed Section 3 Business Concern a fully completed Section 3 Business Certification form including the company name, address, contact person, telephone number, and e-mail address; the amount to be performed/subcontracted; the scope of work to be performed; and the anticipated timeframe for performance of the work.

This procurement will be subject to all applicable sections of the Mississippi Code of 1972, Annotated. Specifically, Mississippi Code of 1972, Section 31-5-37 (2012) “All public works projects utilizing funds received by state or local governmental entities resulting from a federally declared disaster or a spill of national significance, including damages, penalties, fines or supplemental projects paid or financed by responsible parties pursuant to a court order, negotiated settlement, or other instrument, including under any law distributing such fines and penalties including the federal Resources and Ecosystems Sustainability, Tourist Opportunities and Revived Economy of the Gulf Coast Act of 2011 (R.E.S.T.O.R.E.), the Oil Pollution Act of 1990 or the Federal Water Pollution Control Act or similar legislation, shall be subject to the hiring policies established by this section.” By bidding on this project, contractor certifies and agrees to comply with this law. The law also requires contractors submitting bids for public works projects utilizing specified funding to submit the required Mississippi Department of Employment Security employment plan WITHIN SEVEN (7) DAYS OF THEIR BID BEING AWARDED.

Resident contractors shall, in accordance with the laws of the State of Mississippi, be granted preference over non-residents in the award of the contract in the same manner and to the same extent as provided by the laws of the state of domicile of the non-resident. A non-resident contractor shall attach to his bid proposal a copy of his resident state’s current law pertaining to such state’s treatment of non-resident contractors. If the state of residence of the Contractor has no such law then a statement BY AN OFFICER OF THE COURT indicating the State of (Name of State) has no resident Contractor preference law shall be submitted with the Bid Form. Failure by a non-resident bidder to submit either the information herein shall disqualify Contractor’s bid and same will not be considered. Any bid submitted by a nonresident contractor which does not include the nonresident contractor’s current state law shall be rejected and not considered for award.

Bids shall be in letter form with the sealed envelope and bid marked plainly (CITY OF D’IBERVILLE, MISSISSIPPI –– POPP’S FERRY ROAD RELOCATION PHASE IV IMPROVEMENTS PROJECT) and shall be addressed to the City Clerk, City of D’Iberville, 10383 Automall Parkway, D’Iberville, Mississippi prior to the hour and date above designated. In addition, the envelope shall list the Company Name and Address, and all applicable state and local license numbers.

The City reserves the right to reject any or all bids and to waive any informality in the proposal accepted. Bids may be held by the City for a period not to exceed one hundred twenty (120) days from the date of the opening of bids for the purpose of reviewing the bids and investigating the qualifications of Bidders, prior to awarding of the Contract.
